The exclusive recording contract is a useful agreement for a label looking to engage an artist exclusively for a number of years, both as a performer and in relation to his/her songs.

The non-exclusive recording contract is for a label looking to license particular recordings but does not wish to tie up an artist exclusively for a number of years or for a number of releases. It can be used as a trial agreement before moving on to an exclusive arrangement.

Detailed overview of this contract

Exclusive recording contract
The exclusivity applies to both the Artist (as a recording and performing musician) and to the songs written by the Artist during the term of the agreement. An additional number of songs written prior to the term are also assigned in the agreement. The exclusivity in respect to the Artist applies for the length of the agreement and in respect to the songs for the life of copyright (unless otherwise agreed).

The term is sub-divided in option periods which are exercised by the label one at a time according to sales performance of the records.

The Territory is specified as the ‘world and the universe’ and the income from sales is divided in equal parts after certain agreed costs, expenses and advances are recouped by the label (net receipts).

The label promises to fund, release and promote a number of recordings and the artist promises to record and deliver such recordings and to make themselves available for promotion activities.

Non-exclusive record contract
Agreement under which copyright on certain recordings is assigned (from Artist to Label) but
Artist is not engaged exclusively by Label as a recording and performing musician. Artist is
therefore free to assign copyrights not covered in this agreement to other labels.

No Term (length of the agreement) is specified but the Label is required to release the songs
assigned within a defined period. Failure to procure said release (or to keep the songs ‘released’
and generating income) will entitle Artist to reversion of copyrights.

Artist keeps his/her moral rights in this agreement.
